Seeking Justice for Amanda Mayne: The Fight to Hold Law Enforcement Accountable in Domestic Violence Cases

On August 17, 2022, Amanda Mayne tragically lost her life at the hands of her ex-husband, Taylor Martin. In the days leading up to her death, Mr. Martin had stalked, threatened, and harassed Amanda—behavior that was brought to the attention of local authorities. Despite police intervention at Amanda’s workplace and multiple threatening messages from Mr. Martin, no significant preventive actions were taken.

More than two years later, on March 22, 2024, Amanda’s mother, Shauna Mayne, filed a lawsuit against the Salt Lake City Police Department. The lawsuit alleges negligence, claiming that law enforcement failed to adequately assess and respond to the clear and escalating danger Amanda faced.

Unfortunately, on March 27, 2025, the case was dismissed by Judge Laura Scott of Utah’s Third District Court. The dismissal was based on precedent from Tiede v. State and the application of the Utah Governmental Immunity Act, which limits legal accountability for government entities in certain circumstances. Although this dismissal was anticipated due to procedural legal constraints, it paves the way for the next step in the case.

On April 11, 2025, Parker & McConkie, the law firm representing Amanda’s family, filed a Notice of Appeal to the Utah Supreme Court. This appeal aims to challenge existing precedent and push for reform in how domestic violence threats are evaluated by law enforcement.

Shauna Mayne shared her thoughts following the court’s decision:

“I understand this is a step forward for our case and am grateful to know that Mandy is one step closer to getting her day in court. I appreciate all the research and preparation that has gone into presenting a compelling case. I believe we have a chance to make a real difference in how police approach domestic violence cases. Victims of domestic violence deserve to have their safety taken seriously.”

Amanda’s case is not an isolated incident. Similar legal and systemic hurdles are faced by other families seeking justice after domestic violence tragedies—most notably the family of Gabby Petito. Like Amanda, Gabby raised concerns about her safety before her death. Her family’s ongoing legal battle in Utah also challenges the limitations imposed by governmental immunity laws and seeks to reshape how law enforcement responds to domestic violence warning signs.
